ALPEVISION APP & WebAPP TERMS OF SERVICE, CREDITS & LIABILITY POLICY

1. Platform Identification
The ALPEVISION App WebApp and related services are operated by:

Hereinafter referred to as “ALPEVISION”, “the Platform”, or “the Service Provider”.

2. User Categories
Users of the ALPEVISION App are classified as:
•PRO Users: professional users offering services
•Customer Users: users requesting services
Both are collectively referred to as “Users”.

3. Nature of the Service
ALPEVISION provides:
•a digital credit-based system,
•a secure timestamping and certification service,
•a technical platform for file processing and traceability.
ALPEVISION does NOT:
•act as a contracting party,
•act as a payment intermediary for final balances,
•supervise, guarantee, or enforce agreements between users.

4. Registration and Acceptance
By registering and using the ALPEVISION App, the User declares to have:
•read,
•understood,
•and accepted
these Terms of Service in full.
Registration implies explicit acceptance of all clauses contained herein.By registering and downloading the App from the App stores you accept the conditions of the store and these conditions, you accept that the data will be shared with the websites of our group and you are aware that for some functions registration is also required on our sites such as www.alpevision.com and www.alpevision.shop where it will take a few days to validate your request.

5. Credits System
5.1 Nature of Credits
Credits are digital units used exclusively within the ALPEVISION App to access specific platform services.
Credits:
•have no monetary value outside the platform,
•are not legal tender,
•are non-transferable and non-refundable.
Depending on the case and the APP store, our APPs can be provided for a fee and/or by subscription; you are aware that external services on our websites may involve the purchase of credits and/or other paid services.

5.2 Credit Purchase and Non-Refundability
All credits purchased or assigned:
•cannot be refunded,
•cannot be converted into money,
•cannot be exchanged,
including but not limited to cases of:
•non-use,
•account closure,
•disputes between users,
•dissatisfaction with agreements between users.
The application if purchased from the various APP stores is not refundable, our company is not responsible for the suspension and/or interruption of the service and any loss of data of which we advise you to take a screenshot and keep it on your media.

5.3 Credit Expiration
Credits must be used by December 31st of the year of acquisition.
ALPEVISION reserves the right to:
•expire,
•deactivate,
•or render unusable
any credits not used within this timeframe.
Expired credits cannot be recovered.
In the event of total and/or partial suspension of the services of our APP and/or APPs for any reason and/or cancellation and/or removal from the stores, the subscriptions will not be refunded even for the part paid and not enjoyed.

6. Deposit Logic Between Users
When a Customer User pays a deposit requested by a PRO User:
•the deposit is paid entirely in credits,
•the deposit constitutes advance payment between the users only.
6.1 Credit Allocation Example
Example:
If a PRO User requests 100 credits as a deposit:
•50 credits are automatically retained by ALPEVISION as platform service compensation,
•50 credits are automatically credited to the PRO User’s credit balance,
•the Customer User spends 100 credits in total.
This allocation is automatic and irreversible.

7. Contractual Relationship Between Users
The contractual relationship:
•exists exclusively between PRO and Customer users,
•is concluded at the moment the deposit in credits is paid.
ALPEVISION:
•is not a party to such agreements,
•does not participate in negotiations,
•does not guarantee performance or outcomes.
Any remaining balance or compensation:
•is handled outside the platform,
•is the sole responsibility of the involved users.

8. Timestamping and Certification
8.1 Timestamp Function
Files uploaded through the platform are digitally marked with:
•the email address of the submitting user,
•the exact UTC date and time of processing.
This serves to certify that:
•the file was processed through the ALPEVISION network,
•at a specific moment in time.

8.2 Legal Scope of Timestamp
The timestamp:
•does NOT certify ownership,
•does NOT certify authorship,
•does NOT certify contractual validity,
•does NOT constitute legal evidence of agreements between users.
It is a technical traceability tool only.

9. Disclaimer of Liability
ALPEVISION, Perin Alessandro, and related entities:
•are fully extraneous to agreements between users,
•are not responsible for:
•disputes,
•non-payment,
•incomplete or disputed work,
•damages arising from user interactions.
By using the App, Users expressly release and indemnify ALPEVISION from any claim arising from:
•user-to-user agreements,
•service outcomes,
•economic disputes.

10. Limitation of Responsibility
ALPEVISION shall not be held liable for:
•misuse of the platform,
•incorrect data provided by users,
•failures due to external services,
•force majeure events,
•network interruptions.

11. Data Processing & Privacy
User data (including email addresses) is processed:
•solely to provide platform services,
•in compliance with GDPR and applicable EU regulations.
For full details, refer to the Privacy Policy available within the App.The system saves the data on your device, changing or modifying the App on your device may result in data loss. The application accesses our servers to synchronize data for your login, login and logout but does not store the logbook.

12. Termination of Use
ALPEVISION reserves the right to:
•suspend or terminate accounts,
•revoke access to services,
in case of:
•abuse,
•fraud,
•violation of these Terms.
Unused credits remain non-refundable.

13. Governing Law and Jurisdiction
These Terms are governed by Italian law.
Any dispute shall fall under the exclusive jurisdiction of the Court of Vicenza (Italy), except where mandatory consumer protection laws apply.

14. Final Provisions
If any clause is deemed invalid or unenforceable, the remaining clauses shall remain fully effective.
These Terms constitute the entire agreement between the User and ALPEVISION regarding App usage.
IMPORTANT: For all ALPEVISION and AL.PE.VISION timestamp credits to upload photo and/or videos with Alpevision-Timestamp software. Credits are automatically credited to the Alpevision account associated with your billing e-mail and will be valid up to the end of the purchasing year. Timestamp purchases cannot be spent and/or used for other purchases on the site outside of the Timestamp service and will not be refunded. The video and photo certification service is offered by the websites of our group through websites, web apps and App that also use third-party systems, therefore our group is indemnified by You from any dispute related to the certification via timestamp which is and remains a service offered aimed at branding photos and/or videos with our logos/brand/sign and the date with the UTC time relating to the moment of upload by the user.

Credits Validity and Expiration
Credits purchased or assigned within the ALPEVISION App must be used by December 31st of the year of acquisition.
ALPEVISION reserves the right to:
•deactivate,
•expire,
•or render unusable
any credits not used within the above deadline.
Expired credits cannot be restored, refunded, or transferred, under any circumstances.

Timestamping and Certification System
The ALPEVISION system applies a digital timestamp to uploaded files, including:
•the user’s email address,
•the exact UTC date and time of processing.
This mechanism is intended solely to certify that:
•a file was submitted by one of the parties,
•the file was processed and timestamped through the ALPEVISION network.
The timestamp does not certify ownership, authorship, contractual obligations, or economic agreements between the parties.

Platform Neutrality & Disclaimer of Responsibility
ALPEVISION, Perin Alessandro, and all related companies, brands, and websites:
•are not parties to any agreement between users,
•do not intervene in negotiations, pricing, or execution of services,
•do not guarantee the completion, quality, or outcome of any work agreed between users.
By registering and using the App, users expressly release and indemnify:
•ALPEVISION,
•Perin Alessandro,
•affiliated companies and platforms,
from any liability arising from:
•disputes between users,
•incomplete or disputed services,
•non-payment of balances,
•contractual disagreements of any kind.

Deposit in Credits and Contract Formation
When a Customer pays a requested deposit in credits:
•the contract between the parties is considered concluded exclusively between the users,
•the payment in credits applies only to the deposit (advance).
ALPEVISION acts solely as a technical and certification platform.
Any remaining balance, compensation, or settlement:
•is entirely managed between the parties,
•occurs outside the ALPEVISION platform,
•does not involve ALPEVISION in any capacity.

Separation of Roles and Economic Responsibility
ALPEVISION, Perin Alessandro, and related entities:
•do not act as intermediaries, agents, or guarantors,
•do not collect or manage final payments,
•are not responsible for the execution of agreements between PRO and Customer users.
All economic relationships beyond the credit-based deposit are:
•private,
•direct,
•and exclusively the responsibility of the involved users.

User Acknowledgement
By registering and using the ALPEVISION App, the user declares that he/she:
•understands the limited role of ALPEVISION,
•accepts that credits are non-refundable and time-limited,
•acknowledges that ALPEVISION provides certification and timestamping services only,
•waives any claim against ALPEVISION regarding agreements between users.
